Do I have a claim?

Regardless of the type of accident or the severity of your injuries, we must prove that the accident occurred because of the negligence of someone else. In other words someone, other than you, is at fault. For instance it is not sufficient just to show that you have had an accident at work, you must be able to -provethat the accident occurred because of your employer's negligence or breach of one of the many Health & Safety regulations. Similarly, if you trip because of a defect on a public road or footpath you must be able to prove that the Local Authority has failed to maintain the highway adequately. Of course, if you are involved in a road traffic accident you must be able to show that it was the other driver's fault and so on.

What will it cost me?

From 1st April 2013 the Government changed the way in which personal injury claims are funded.

We can still offer "no win no fee". If you win a success fee is payable by you. This will be deducted from your compensation and will never be more than 25%. So, in most cases you’ll still receive at least 75% of your compensation.

How long will it take?

Generally speaking most straightforward accident claims take somewhere between 6 and 12 months to conclude. At Yes we want to be sure that you are well on the road to recovery from your injuries before advising you to settle. This way we can be sure that you are getting the right amount of compensation. Once compensation has been paid the claim is at an end and you can't go back for more compensation if your condition doesn't improve as hoped.

Can I get private medical treatment?

Both solicitors and insurance companies have a duty to work together to consider the needs of each injured person making a claim at the earliest practical moment. Therefore if you do need any form of medical treatment such as physiotherapy, counselling or even a referral to a Consultant, for example, then this can be arranged for you. At Yes, we want to put you back in the position you would have been in the accident not occurred, we will therefore do our utmost to secure private medical treatment for you at the earliest opportunity. How much will I get?

It is very difficult for any solicitor to answer this question at this stage as it depends on so many things –including how badly you were injured, what treatment you've had, if you've been paid while off work or not, if you've needed someone to look after you, what extra expenses you've had.

There are two types of compensation in a personal injury claim :-

Firstly you will receive compensation for the injury itself. As a rough guide please check out our claims calculator for the ranges of awards for certain injuries.

Secondly at Yes we will claim for all the money you have lost or had to pay out because of the injuries sustained in the accident; things like Loss of Earnings, the cost of care and help (whether this is paid for or provided free by family and friends), extra travel expenses, prescription charges and other medication, physiotherapy to name a few.
